ENDAUM appealed the decision and on May 25, 2000, the NRC agreed with one of ENDAUM's contentions. The NRC found that HRI had failed to submit a financial assurance plan for the mining project and barred the company from using its' license, until such a plan is submitted and approved. "The decision of the Commission means ENDAUM was right, and that HRI cannot use its' license to start this unneeded and unsafe uranium project across the road from my house," said ENDUE member Larry King of Churchrock. On may 16, URI announced that " the company has exhausted all of its readily available sources of cash to support continuing operations and expects to be unable to continue in business beyond the next 45-60 days unless it can secure a cash infusion."
