Date: 03 Dec 1999 13:43:05 PST I thouroghly enjoyed Dr Alex Patterson's visit to the sunshine state. I did not like the Groove @ City Walk's venhue. It is like a gigantic parking garage / theme park. Not to mention that it cost way too much to park there... although very secure. I got to the groove early and bought my ticket right away. I ate a pizza that cost way too much. After eating the pizza I noticed pasta sauce on the football jersey I was to give to LX. "A little Club Soda Will Get That Out!!" -he he he LX didn't even notice! Inside the club a short piercing lil fellow asked if I was Joe. Indeed, Eric got a warm hand shake and cordially invited me over to Liquid W. I showed them the sattillite photo post cards I was to give to the man and detailed my two new friends about the Trent Dilfer Tampa Bay Bucs (#12) jersey I was to gift to LX. I was told he was backstage. So, I just walked through to the back!!! I quickly was ushered back to the door and told to wait, security would retrieve Alex for me. So, two seconds later he appears. I thought of him as average size if not slightly stocky and strong. I quickly gave him the jersey and postcards. We, flipped through the cards together and he explained to the three of us about his set called "hardware". I also asked him to pronounce "Rodulius (SP?)". I made sure he was welcomed in FL. He said all was going well. I next thanked him for showing up. He exited back-stage b/w the jersey and postcards high above his head. Next night, I found this final FL date: "Milkbar @ Paladome ... club 316". What a dogdgey place that was! It had walls that vibrated. All black inside. Tonite, LX wears a cool vest and, not dissapointed at all by a very cool Chelsea United premiere football club's away jersey!!! It said "AMIGA" on the front. As I approached him to say high again... I gave him peace knuckles and he tried to open my overshirt to reveal my silver logo ORB T. Oh, My, God! My favorite D.J. tried to strip me! LX you can be my Spanish girl any nite!! The set I recorded b/w mic and hand held Panasonic tape recoreder got taken. I taped a good hour of his set when a woman told me to give her the tape right away! Right away I did and told her LX said it was O.K. While talking to him B-4 his set he stated that he did not know how to tape the show. I told LX that I thought I had it covered. I said "Walk this recording up to the D.J. booth and give it to LX." She did just that. LX nearly stopped playing his record as the rude lady barged on stage! Well, in san-fran and berkeley there's AMOEBA music... it is truly the only record store you will ever need. It's about the size of a basketball stadium; they have vinyl and cd, new and used, from mainstream to the completely odd. And as if that's not enough, they're cheap. The san fran one is on Haight St. close to golden gate park. I recommend that you walk all the way from market st. to the park on Haight; it is a great experience (just make sure you don't wander into the tenderloin). Also along the way you will run into a really cool record store/label/studio called Spundae recordings. They are friendly, and sell cool DJ swag along with about the finest selection of german, french, and american trance and house (I mentioned something about the orb while I was there and I got smoked out quite nicely.) If you're looking for something more commercial-ish, the virgin records megastore on Market has some very nice picks, and a surprisingly cool imports/bootlegs section (I think I saw the assassin single and oxbow lakes here, as well as orbscure trax for like $35). Anybody who is getting a copy of the LX DJ set from me should know that: I used a Sony TCD-D8 portable DAT recorder set at 44.1kHZ (CD format) wiith Oade "Stealth" microphones, which are matched within 2 dB and also have the matching op amp installed in my recorder for maximum fidelity. I transferred the master DAT to my computer using a Soundblaster Live's SDIF I/O connectors, keeping the transfer purely digital. I mastered the recording using Sound Forge XP 4.0, which gives me the ability to normalize, remove spikes, increase the output fidelity, edit and track the recording for the master file. All of the discs I have sent out and will be sending out are burned directly from the master file on my hard drive, instead of a master cd, thus eliminating an additional step for data corruption. I also include a 4-page high gloss full color sleeve, a double sided full color tray insert, and disc art for both cds and package them in a slimline double case. The images that I used for the packaging were scanned from my autographed show flyer, ticket stubs, and various other odd items related to the contents, which I retouched and added text to using Adobe Photoshop. The sleeve art is printed at 300 dpi on a HP 895 CXi Deskjet printer at photo-quality speed. So far, everybody I have heard from is very satisfied with the final product they receive. If there is anything I fell that is missing from this set is the individual track titles, which I unforunately do not know. I know there's people out there that are satisfied with MP3's quality, but I'm not. I won't take the time or effort involved in encoding it, for I think it takes away from the overall tangibility of the recording. Nonetheless, if somebody else wants to encode it, I have no problem with that. The only thing is that I want a note listed with the MP3 file that lets the person who has access to the file to see that they can obtain a better quality recording of the show - from the source. I'm not looking to be put on a pedastil or nothing, I just want people to obtain the best quality recording they can. Now some people think that the DJ LX set is only worth 2 cdrs. I think that's insulting, honestly. Putting a price on all the equipment used to create this is in the thousands of dollars, not to mention all the effort that went into making it what it is. Anybody with a cdr drive can copy a cd, but it takes lots of time, money, effort and willingness to take the sounds form the air and turn it into a tangible, attractive piece of high quality audio. This attitude Gavin is talking about is unfortunate. *Especially* if you are getting first generation copies directly from him. He puts a huge amount of work into his discs and inserts, and that is certainly worth more than a couple of blanks (currently available in jewel cases for less than $1 each). Heck, even second generation copies are worth more than that. It takes time and resources to burn high quality copies. (If you want copies read at 48x and burned at 6x with no QC, inserts, labels, or jewel cases, blanks might do it...) Now, n-th generation copies of uncertain provenance with all sorts of artifacts, or de-MP3-ed copies are almost certainly only worth blanks...but that is another argument. ;) Anyway, they are making their way out into the community; I'm sure someone will MP3 them, and someone else may well be willing to burn copies for blanks...so they will be available to more and more people as time goes on. But. High-quality copies are always going to fetch a premium. I recently met a company who plans to do a WebTv (like www.pop.com) and they are interested in developing their own series developed in FLASH movies. I pitched them one of my projects, they seem to be very interested, although we're very early in the process. I plan to do a weekly serie written by myself, with my own universe ("Twin Peaks meets The Orb"). But what does it have to do with you ? I plan to include new music in this program. I need you for that, those who wrote unknown techno/house/ambient tracks. So email me privately (not on the lists) if you have these skills. Right now, I dont have a contract with this new company, I wont get paid for a long time (we've got to find investors, but these investors have to see what's on this WebTv : so I'll have to do a pilot for March 2000), so I wont promise you lots of gold, but it can happen. What I can promise you right now is that if your music is included on the show, you'll have credit for that in the end titles. I remember reading the review of /Adventures/ in Melody Maker the week after it came out the the UK ... and, by God, I checked the shelves that minute and of course the album hadn't arrived in the US yet but they did have the compact disco of A Huge Ever Growing Pulsating Brain... which I decided I had to have--even if the music was terrible--just for the title alone. Well, I was intrigued enough to practically sit on the steps of Rough Trade until the album arrived in the States. I'd stopped listening to the Orb for a while lately, and then decided to sell a bunch of stuff since I'd not been listening to it, and then decided to listen to it just to make sure, which turned out to be a really bad move. They are Distributed through Navarre if that helps at all. they also ahve a few tracks on a couple of Waveform Records Compilations. The first Being One.A.D. (Ambient Dub). and the other is Two.A.D. (very original huh), I have a copy of One.A.D. But I believe these comps may be out of print. Pretty Good Stuff but I think all the song on them can be had on the Full lengths of the albums, but it's good starting ground to pick up on other artists that are similar to HIA. I first learned about them about maybe 5 years ago, on this syndicated Radio show that played in Chicago from 10pm-12am on WNUA (you know that crappy light Jazz, new age station). Anyways the show was called "musical startstreams" and it's host name was Forrest. He played a lot of really cool Ambient and dub, and space out tracks. Sore were kinda cheezy New age stuff. Some was really cool Like HIA. I think Waveform Records was affiliated with that show or was owned by the same people or something, because they played thier albums all the time and had tons of Radio spot for thier CD's. Sorry, dude, but it is perfectly legal to cover any song you want, as long as you pay the right people. You may not like it, and you can give Sony grief about it, but there is no legal recourse here. Go to any US CD shop and you will see tons of CD-singles of current hits by cover artists. US record companies don't release very many CD-singles of current hits; they believe it takes away from album sales. So these "cover artists" fill the gap, making copycat versions of the same song (and numerous remixes besides) and using similar artist names. Believe me, if the majors can't stop this practice, UR won't be able to, either. It surprises me that Sony decided to get into this business, and I agree that they deserve some pressure for this: angry letters, boycotts, whatever. The reason I spoke up on this subject at all is that I know I read an article sometime this year about a company whose entire business is recording cover versions of popular hits and issuing them on CD-single when the US record company doesn't issue one. I figured out the name of the company ("Twin Sounds") but I was unable to dig up the article again. They've done versions of "What It's Like," "Pretty Fly (For A White Guy)," "Zoot Suit Riot," "Tubthumping" and "Fly Away" in the recent past, and it seemed highly unlikely that they actually got permission from either the band, publisher, or record company to issue CD-singles of these songs, especially while they were still hits on the radio. But they've built a whole business on it and have never been sued, so it must be legal, because as we all know, these record companies go after everyone if they can. And since I'm not a lawyer (and this is not legal advice), I don't have these concepts on the tips of my fingers. So I did a little research... Anyways, I was able to figure out the legal concept I was referring to. It's called a "compulsory mechanical license." Once a song is recorded and released, I don't need the band's or publisher's permission to get one of these, and once I have one, I can cover that song. I *cannot* make a "derivative work" out of it (change the main melody or lyrics, sample it and build another song, etc.); for that I need approval. But I can make a note-for-note soundalike recording of it. Note that such a license is "compulsory." I take this to mean that you can't issue a song and not make one of these available. I used the following three web pages (among others) as my sources. The way I interpret all these articles is that the only way for you to prevent me from covering your song, is for you to never release it. Of course, all of what I am referring to is relevant to the US; I have no idea if it is the same elsewhere. Based on all this, *if* this were taking place entirely in the US, and *if* I've interpreted everything correctly (again, this is not legal advice), then it looks to me like UR only has a legal case if (a) UR never released the song, (b) Sony never acquired a compulsory mechanical license for the song, or (c) Sony did some other illegal thing in the process of issuing the recording. If there's something I'm missing here, please fill me in, and please point me to a resource that explains it. I still think that it was a pretty slimy thing for Sony to do, and I'm all for pressuring them into withdrawing their version of the song.
