I got to meet lx briefly before his set. He spun in the "ambient" room. There was probably 100-200 people that were in the room during his set. It was rather cool because I got to stand about 7 ft. away while he was spinning, unlike the main room where the dj's were up on a stage thing. His set about about 2 hrs and was pertty hard. The only complaint that I had was that the volume was real cranked to over come the room below and distored the musik. If, say you are a broadcaster and are doing, say a radio show, you can distribute the tapes all over hell, as long as you don't get anything ($$$) in return. I can tape my radio show and actually call it an original work - It becomes an original work because I put it together the way I put it together. I won't get screwed as long as I give credit for the original songs to the original artists. If you were to say host a show and introduce each track and identify the artist, you'd be perfectly fine. Just don't sell the stuff. Also, you could be completely safe by just giving a tape to someone, as long as you don't agree to give them a tape in return as payment. You could give me a tape...and I could give you a tape. If they really went through the trouble of sueing you, they'd have to prove somehow that each tape was payment. The main loophole is you're using groups of other people's material to create something unique. I suppose that's how most of these cheesy house dudes get away with selling their mix tapes at the local mall. Hell, these guys don't even put song titles and credits on the tape jackets...they have a binder at the register that gives you the track listings. Pretty terrible Since they mix it all together it becomes a unique work which actually falls under copywrite protection. I actually put together a promo tape for my radio show a few years back. It had all kinds of stuff on there, including bits of a ren & stimpy cartoon. If I actually needed to justify its creation in court, my reasoning would go like this... I put your artist on a tape with a group of other artists whom are highly respected in this particular genre. I advertized my show on the label of the tape so that people who liked the music on the tape would tune into my show on a weekly basis. If they tuned in to the show, you're music might experience an increase in radio play, thus generating more attention in the CMJ weekly reports, thus generating more exposure on a national level, thus making you more money (greedy fucks) and, I did it all for free (no cost to the label...they tend to like that) What about the artists? Well...they might get pissed if you put a techno artist's track on a country music compilation you made for your girlfriend...honestly though lets be realistic. What are the realistic odds that an artist is: a) going to find out about the copy you made of your friends favorite car mix b) going to actually be pissed about it c) go through the trouble of sueing you for it? Not high at all. That whole Clinton law thing was made to crack down on the folks that carbon copy knock-offs of new albums and videos in China and Mexico and try selling them as the real genuine deal (also video games - we almost sanctioned China for that!) Art (who likes to pontificate...I had to sit through Media Law through the Spring Semester of my senior year in college and I'm delighted to have a chance to spout on this crap) - -----Original Message----- From: Aron Shevis To: 'orb' ; 'zombies' Date: Monday, January 05, 1998 10:41 AM Subject: FW: bootlegs, tapes > > > > ---------- >From: Siouxsie and the Banshees Discussion >List[SMTP:SATB-L@BROWNVM.BROWN.EDU] >Sent: Sunday, January 04, 1998 11:33 PM >To: Multiple recipients of list SATB-L >Subject: bootlegs, tapes > > > >>> Someone posted this on the Jonathan Richman site.... >>> >>> I just spent the better part of two days checking this stuff out and >it >>appears to be legit. It was done with 3D Studio Max and Character Studio. The original animation has a photograph of a real baby's face mapped onto it, but the one on the show was "fully" 3d. There's a demo of Character studio, with an ogre, dinosaur, man etc..., doing the exact same dance. BTW: the song is "Hooked On A feeling" (or whatever it's called). - - # Need help using (or leaving) this mailing list? # Email majordomo@xmission.com with "info orb" in the message. # Postings must go to orb@xmission.com -- replies go to original sender. # Latest Orb info: http://www.theorb.com/orbulletins.html -- look here first! ------------------------------ Date: Tue, 6 Jan 1998 21:15:35 EST From: LiquidW Subject: Re: (orb) How you got into the Orb i took mescaline , and heard - - # Need help using (or leaving) this mailing list? # Email majordomo@xmission.com with "info orb" in the message. # Postings must go to orb@xmission.com -- replies go to original sender. # Latest Orb info: http://www.theorb.com/orbulletins.html -- look here first! ------------------------------ Date: Tue, 06 Jan 1998 18:32:19 -0800 From: Blaine Cook Subject: Re: (orb) Re : How I got into the Orb At 11:18 98.01.06 +0100, you wrote: >A friend of mine gave me his copy of "UFOrb", I thought "These tracks are >very long ! Nowadays it seems 50 mins is an average length, and no-one is saying the albums are little.. I remember not too long ago, someone was asking about an Orb tattoo. I always wanted the Orb Factor 6 logo from the Kiss EP in just black and white, though. I thought about it for quite a long while, but I already have a Meat Beat Manifesto tattoo on my right calf that I got when I had first gotten into them in 1990, and now I wonder exactly why I still have it (since I don't listen to them very much anymore), so I didn't want to have the same experience with the Orb, who I can't seem to get enough of.
